10.00 a.m. – Day 38 of the Trial: Court goes into closed session

The Prosecution presented Prosecution Witness TF1-362 with the order for protective measures dated 11 May 2005 and therefore requested a closed session. The Defense made application to resent this order for the following reasons:
– the order was issued on a date before the Accused in this case was even in custody;
– the name of this Witness is already in the public domain.
The Prosecution referred to broader implications extending to other witnesses for the need of feeling secure and protected while giving their evidence.

Subsequently Presiding Judge Teresa Doherty directed a closed session, bound by order of trial chamber 1.
