1:00 Judges allow testimony from Corinne Dufka, who now takes the stand; judges will evaluate defense objections after hearing her testimony

Presiding Judge Doherty:  Without hearing the witness, we consider each of the matters raised by the defense to be premature.  Defense will have the opportunity to cross-examine the witness.  We will defer a decision on whether to admit her report into evidence until after we have heard from her.

Defense counsel Terry Munyard: This is a weighty matter, and we would like to make written submissions.

Judges confer.

Judge Doherty: We will hear the witness, and if we feel it would be helpful to have something in writing, we will indicate that to both parties and provide time for such submissions.
